Delhi HC Questioned BCD Over Online Enrollment Procedure for Law Graduates; Read Full Story


Delhi HC questioned Bar Council of Delhi (BCD) if they had set any procedure for the online enrollment for law graduates during the ongoing COVID 19 pandemic.

Abhishek Anand, Gaurav Kumar, Priya Ranjan, and Anurag Yadav, the four law graduates have complained that they were from Bihar and it would be impossible for them to visit Delhi for the physical enrollment process.

 Justice Navin Chawla posed the query and issued notice to the Bar Council of Delhi (BCD) and Bar Council of India (BCI) on a plea raised by the four law graduates.

The law graduates informed the court that they won’t be able to appear for the All India Bar Examination without enrolling themselves and no information was provided regarding the online enrollment.

The law graduates also stated that the last date to apply for the All India Bar Examination is December 19, 2020. 

Bar Councils of several other states like Kerala, Karnataka, Tamil Nadu, and Andhra Pradesh have commenced the online enrollment process of law graduates in August - September 2020.

A similar plea was filed in the month of August and BCD stated that to address the issue of online enrollment or electric mode of enrollment, necessary steps would be taken but no such steps have been taken yet, the law graduate stated.

In addition to online enrollment, the law graduates have also requested BCD to provide directions to exempt them from filing rent agreements or proof of residence till we return back to normalcy.

The law graduates also requested the Delhi HC to declare that the requirement of rent agreement/ proof of residence as one of the conditions precedent for enrolment in BCD was “illegal and unconstitutional”.
