The Bar Council of India (BCI) on Wednesday, resolved to appoint a committee to draft rules for the moratorium imposed by the opening of new law colleges.
As per the bar body statement, the council has filed an appeal against the same on December 04, 2020. However, it would be more feasible if a committee is appointed specially for drafting rules for a moratorium on opening law colleges, BCI officials further added.
The moratorium was imposed for a duration of three years by the Bar Council of India (BCI) on August 11, 2019, on the opening of new law colleges/centers.
As per the official statement, “The moratorium imposed vide council resolution was challenged by way of a Civil Writ Petition before the Punjab and Haryana High court and the Court has set aside the Moratorium being violative of Article 19(1)(g) of the Constitution of India,”.
“BCI has filed an appeal against the above-referred order dated December 4, 2020, but it realizes that it would be feasible and better if a Committee is appointed to consider the drafting of Rules for a moratorium”.
The bar body further added that the moratorium will be further used to place before the Legal Education Committee. The moratorium will be placed within a statutory sanction under section 10 (2) (b) of the Advocates Act, as was observed by the Punjab and Haryana High Court.
The Bar further added that the authorities have now decided to withdraw their appeal against the order of Punjab, and Haryana High Court. The Bar Council has further resolved the undertaking of surprise visits to colleges and centers of legal education.
Since due to the current pandemic situation in the country, undertaking surprise visits to the College, and Centers of Legal Education might not be possible as colleges have been shut down to ensure the safety of the students.
BCI added that the council has observed that the state government usually refers to issues with the “No Objection Certificate” in a very casual manner. The issues are often dealt with without consideration of the demand of particular areas.
The Bar Council of India has imposed the moratorium to ensure that the growth of law colleges and centers of legal education will be improvised in the country with standards provided by the legal education of law colleges/centers of legal education.
